White House takes aim at frivolous patent infringement lawsuits
WASHINGTON, June 4 () -- The White House said Tuesday it was stepping up its agenda on improving U.S. patent laws to prevent frivolous lawsuits.Using guidelines developed by the National Economic Council and the Council of Economic Advisers, the White House said it was pushing forward with five executive actions and seven legislative recommendations "to protect innovators from frivolous litigation and ensure the highest-quality patents in our system."Some of the steps are designed to discourage "Patent Assertion Entities," which are companies President Barack Obama said "don't actually produce anything." Instead, the president said, the company's purpose is "to essentially leverage and hijack somebody else's idea and see if they can extort some money out of them."These companies are often called "patent trolls," said the White House in a statement that also called attention to "Smartphone Patent Wars."In the highly competitive field of smartphone innovations, "several major companies spend more on patent litigation and defensive acquisition than on research and development," the White House said.The legislative recommendations include forcing greater transparency on parties suing for patent infringements, which might cause some to think twice about filing a frivolous case. The White House is also seeking to give courts more leeway in awarding fees to prevailing parties, giving judges more discretion in punishing parties for "abusive court filings."The executive actions include forcing parties filing lawsuits to update patent ownership information on a more timely basis, to prevent patent trolls from setting up shell companies that can be used to keep information out of courtrooms.The White House also issued an executive action that calls for "empowering downstream users."
